Selling

Selling an inherited property

You have inherited an apartment building or a mixed-use building and do not want to manage it yourself? Here are the most important steps – and a buyer who decides directly.

First the land register, then the sale

On inheritance, ownership and current leases pass to the heirs. For the heirs to be able to sell, the land register usually has to be corrected. For this the land registry requires proof of inheritance, usually a certificate of inheritance or a notarised will with the record of its opening.

The purchase contract – like every property purchase in Germany – is notarised. The notary can coordinate the necessary steps.

Several heirs: decide together

If the property belongs to a community of heirs, the heirs can only dispose of it jointly (Section 2040 BGB). All co-heirs must therefore agree to a sale. A buyer with a clear offer and a manageable process can help to reach agreement.

What you need for a first conversation

  • Location and type of the property
  • If known: number of units, living space and current rental income
  • Existing documents such as a land register extract, leases or the energy performance certificate
  • One contact person for the community of heirs

Taxes and deadlines

Inheritance tax and possible taxes on the sale proceeds depend on the individual case. Please clarify these questions with your tax adviser before you sell.

Questions and answers

Frequently asked questions

Can I sell an inherited property with tenants?

Yes. Existing leases pass to the buyer on sale. We buy tenanted property for our own portfolio.

The property needs renovating. Is that a problem?

No. We also buy property in need of refurbishment or with vacancies and plan the modernisation ourselves.
